1. Prohibited content
You must not use Bytespike to generate, store, distribute, or attempt to elicit: child sexual abuse material (CSAM); content depicting non-consensual real-person sexual content; content inciting imminent violence, terrorism, or genocide; content used to plan attacks on critical infrastructure; content infringing third-party intellectual property at scale.
2. Prohibited behavior
You must not: send automated spam at scale; perform mass unauthorized scraping of copyrighted content; use Bytespike to circumvent the terms of service of any upstream model provider (e.g. relay requests to dodge rate limits, region restrictions, or content policies imposed by OpenAI, Anthropic, Google, or others); attempt to extract model weights or system prompts; deploy the API in adversarial security testing without our written consent.
3. High-risk advisory domains
Bytespike outputs are generated by stochastic LLMs and must not be presented as professional advice. If you build applications providing medical, legal, or financial advice to end users, you are responsible for adding clear disclaimers, having qualified humans in the loop, and complying with HIPAA, GLBA, FINRA, or comparable regulations as applicable. Bytespike is not a covered entity, business associate, or financial institution.
4. Personal data and PII
Do not submit personal data of others without a lawful basis. Do not collect, scrape, or transmit unauthorized PII through the API. If your use case involves processing personal data of EU/UK/PRC residents at scale, request a Data Processing Addendum at legal@bytespike.ai.
5. Enforcement
We may investigate suspected violations through automated detection and human review of metadata (not prompt content, except where legally required). Confirmed violations result in suspension, termination, and forfeiture of unused credits. We cooperate with valid law-enforcement requests and applicable mandatory reporting obligations.
6. Report a violation
Report suspected AUP violations or abuse to legal@bytespike.ai. For urgent CSAM concerns, also contact NCMEC's CyberTipline directly at https://report.cybertip.org.
